Yes, you need to deducted tds as per new rates effective 01/10/2009. Applicable section would be 194J
TDS ON Salaries are pertaining to Gross Earning of the employee in a F Y Less deduction like insurance, conveyance allowance,ect,.. and expected declared income divided into number of months to be TDS dedecuted.,
Ex. If any employee earn out of salary, taxed Rs. 6600/12 months monthly tds deduction is Rs.550/-

Dear Sir,
A salary is never paid to a consultant, it is always to an employee. so if u are paying an maount to a consultant then it is a profesional service falling under Section 194J and TDS will be deducted at @ 10%. it is immaterial whether u are paying amount monthly, quarterly or annually. So never ever use a word slary while making payment to a consultant or professional.
